Former employee denies abusing fiduciary position

A man yesterday filed a counter-protest in the First Hall of the Civil Court in which he denied allegations made about him that he had abused of a fiduciary position with Greenlines Environmental Services Ltd.

Publius Said was responding to the judicial protest filed against him, against John A. Said and against Fair Trading Ltd by Greenline Environmental Services Ltd.

In his reply Mr Said told the court that, at the request of Greenlines, he had given up his work in order to act as yard manager with this company.

He had carried out his duties in an honest and loyal manner, and added that at no time had he been involved with the actual business of the company.

He had, therefore, never been in a fiduciary position, nor had he been aware of any sensitive information about Greenlines Environmental Services Ltd.

Mr Said further denied that he was in possession of any documents or assets belonging to the company.

On the contrary it was Greenlines that had retained thousands of euros belonging to Mr Said, and he added that he was taking legal action to recover the money.

Mr Said told the court that when his father, John A. Said, had opened his own company under the name of Fair Trading Ltd, Greenlines had terminated his employment on the grounds of conflict of interest.

Such termination, said Mr Said, was unjust and unlawful and he was taking action against Greenlines in the Industrial Tribunal.

In conclusion Mr Said formally protested against the company and held it liable in damages.

The counter protest was signed by lawyers Philip Galea Farrugia and Joe Mifsud.
